This Licensing Agreement ("Agreement") governs the use of all photographs, video footage, and related media ("Media") produced and delivered by Installation 04 Media ("we," "us," or "our") to the client ("you"). By booking our services or accepting delivery of Media, you agree to these terms. Any signed service contract with different terms takes precedence over this Agreement.
Copyright Ownership
All Media produced by Installation 04 Media remains our intellectual property. We retain full copyright under United States copyright law. Delivery of Media grants you a license to use it as described below — it does not transfer copyright ownership.
Personal Use License
For personal sessions and events (weddings, birthdays, portraits, private parties), you receive a non-exclusive, non-transferable license to:
- Download, share, and print the delivered Media for personal, non-commercial purposes
- Post the Media on personal social media accounts
- Share the Media with family and friends
Credit is appreciated but not required for personal use.
Commercial Use License
For commercial clients (real estate, construction, hospitality, product, corporate, and similar work), you receive a non-exclusive license to use the delivered Media for the marketing and promotion of your business, including websites, listings, social media, advertising, and print materials, unless otherwise specified in your service contract.
Commercial licenses apply only to the business named in the booking. Resale, sublicensing, or transfer of Media to third parties (including other businesses, publications, or stock platforms) requires our prior written consent and may require an additional license fee.
Real estate note: Listing media is licensed to the booking agent or brokerage for the marketing of the specific listed property. Use by other agents, brokerages, builders, or vendors (e.g., stagers, contractors) requires a separate license.
Prohibited Uses
Unless expressly agreed in writing, you may not:
- Sell, sublicense, or redistribute the Media for profit
- Enter the Media into contests or submit it to publications without notice and credit
- Apply heavy edits or filters that materially alter the Media and imply they represent our work
- Use the Media in a defamatory, unlawful, or misleading manner
- Claim authorship of the Media or remove watermarks from proofs or previews
Our Usage Rights
We retain the right to use all Media for our portfolio, website, social media, marketing materials, and contest or publication submissions. If you prefer that your Media not be used publicly, contact us at rudy@installation04media.com and we will accommodate reasonable requests. Written privacy or exclusivity arrangements in your service contract take precedence.
Exclusive Rights & Buyouts
Full copyright transfers, exclusive licenses, or usage buyouts are available for an additional fee and must be agreed to in a signed written contract.
Model & Property Releases
You are responsible for informing us of any release requirements for your project. Where we photograph identifiable people at your request (e.g., models, staff, event guests), you represent that appropriate permissions have been obtained unless we have agreed in writing to secure releases ourselves.
Delivery & Archival
Media is delivered digitally in high resolution unless otherwise agreed. We may archive files for a limited period as a courtesy, but long-term storage after delivery is not guaranteed. Please back up your files upon receipt.
Termination
We reserve the right to revoke any license if these terms are violated. Upon revocation, you must cease use of the Media and remove it from public platforms where feasible.
Governing Law
This Agreement is governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Dallas or Tarrant County, Texas.
